Does the MCU S5D9 part numbers R7FS5D97C3A01CFB#AA0 and R7FS5D97E3A01CFB#AA0 has the same form fit and pins to pins function except for the program memory size?

That is correct. In the datasheet for the S5D9 series (https://www.renesas.com/us/en/document/dst/s5d9-microcontroller-group-datasheet-r01ds0303eu0130?r=1054626) you'll see on page 12 that these two are functionally the same and on page 21 that they are pin-to-pin compatible without any exceptions as well.
For anyone that may stumble across this question in the future, if you check out the Renesas Synergy Nomenclature (https://www.renesas.com/us/en/document/gde/renesas-synergy-nomenclature?r=487781) you can see that the difference between the C and the E simply means that the C version has 1024KB flash size and the E version has 2048. The FB that both have at the end of their names means these are both 144 pin LQFP packages.

The datasheet has the decoder for the part. The datasheet also shows the parts in the same column, indicating they are identical. You are correct on sizing..
